PRIVACY NOTICE PURSUANT TO ARTICLES 13 AND 14 OF REGULATION (EU) 2016/679 FOR APPLICANTS

Dear Data Subject, we wish to inform you that the processing of your personal data related to the submission of your spontaneous application, is carried out in accordance with the regulations on the protection of personal data (EU Regulation 2016/679, hereinafter referred as the "Regulation", Legislative Decree 196/2003 as amended by Legislative Decree 101/2018 and subsequent amendments and additions), therefore it will be based on principles of correctness, lawfulness, transparency and protection of your privacy and your rights.
Pursuant to articles 13 and 14 of the Regulation, we therefore inform you of the following.

1-DATA CONTROLLER

The Data Controller is Baoli EMEA S.p.A., with registered office in Viale de Gasperi, 7 - 20045 Lainate (MI), who can be contacted for any question relating to the processing itself, as well as for the exercise of the rights referred to in articles 15 to 22 of the Regulation, at the above address and/or at the following e-mail addresses: gdpr@baoli-emea.com and baoliemea@pec.baoli-emea.com

2- TYPE AND SOURCE OF PERSONAL DATA COLLECTED

In order to carry out personnel selection activities, Baoli EMEA S.p.A. collects and processes personal data relating to you (the "Data"), which may include special categories (Art. 9 of the Regulation), such as, for example: name, surname, date and place of birth, tax code, residential address, e-mail address, telephone number, information relating to your education and skills, salary data, belonging to protected categories ex L.68/99, indication of previous employers as well as information relating to family ties and/or assumption of political office.
These Data are collected directly from you, or from publicly accessible sources and bodies and/or third parties expressly appointed for this purpose (such as, for example: employment agencies, job centers, recruitment companies, social security and welfare institutions, previous employers, training institutions, etc.).

3-PURPOSE OF THE PROCESSING

The processing of Data is aimed at pursuing the following purposes:

  1. Correct activation, management and completion of the personnel selection process and verification of your skills for the possible establishment of an employment relationship;
  2. To contact you for future and further job positions, deemed by Baoli EMEA S.p.A., relevant to your profile;
  3. To contact you for future and additional job positions related to your profile, by the other companies of the KION Group to which Baoli EMEA S.p.A. belongs.

4-LEGAL BASIS AND METHODS OF DATA PROCESSING

The processing of your personal data, for the purpose of selection and evaluation of personnel (point 3.1 of this privacy notice), has as its legal basis the performance of pre-contractual activities carried out at the request of the Data Subject (Art. 6.1, lett. b)).
The possible processing of special data reported in the curriculum vitae sent by you and/or communicated during the interview, has as its legal basis the need to fulfill the obligations and exercise the specific rights of the Data Controller in the field of labor law (Art. 9.2, lett. b)), as clarified in the provision of the Italian Data Protection Authority no. 146/2019 "Provision containing the requirements relating to the processing of special categories of data".
With regard to the additional purposes referred to in point 3, the legal basis for the processing of the Data is your free, specific, informed and unequivocal consent.
The processing:

  • it is carried out by means of the operations or set of operations listed in Art. 4,1, point 2) of the Regulation, which consist of: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, erasure and destruction of data;
  • it is carried out both with the aid of electronic or automated tools and manually and by means of paper archives.

5-PROVISION OF DATA

The provision of Data for the purposes related to the correct execution of the selection process is mandatory; therefore, any refusal to communicate data, will prevent Baoli EMEA S.p.A. from processing your application. Conversely, with regard to purposes based on consent, the provision of Data is optional and will not hinder the evaluation of your application in any way.

6-RECIPIENTS AND DISCLOSURE OF DATA

To the extent necessary for the purposes, your data may be communicated to employees duly instructed and trained by the Data Controller and/or to external parties, expressly appointed as data processors, or companies and/or firms that provide consulting services, head hunting companies, technical partners and similar.
The Data will not be subject to dissemination.

7-TRANSFER OF DATA TO THIRD COUNTRIES

The Data will not be transferred to third countries outside the European Economic Area for the purposes described in point 3 above. Should this occur, Baoli EMEA S.p.A. will carry out such transfers after having assessed the level of protection recognized in the country of destination and only if there is an adequacy decision of the European Commission, or by using the so- called standard contractual clauses approved by the European Commission, with specific information to the data subjects.

8-RETENTION PERIOD

The Data collected will be kept for as long as necessary to fulfill the purposes set out in point 3 above, i.e. for as long as necessary to evaluate your application. In the event that the Data Subject has denied the possibility of being contacted for future open positions at Baoli EMEA S.p.A. or at other companies belonging to the KION Group, the Data will be immediately deleted at the end of the selection. Conversely, your data will remain in our systems for 24 months after you submit your application, unless you consent to the extension of storage.

9- DATA SUBJECT RIGHTS

The Applicant, in his/her capacity as Data Subject, in accordance with the law, will always have the right to revoke any consent given, and may also exercise the following rights at any time:

a) the "right of access" and specifically to obtain confirmation of the existence or otherwise of Personal Data concerning him/her and their communication in intelligible form;

b) the "right to rectification", i.e. the right to request the rectification or, should he/she have an interest, the integration of Personal Data;

c) the "right to erasure", i.e. the right to request the cancellation, transformation into anonymous form of data processed in violation of the law, including those whose retention is not necessary in relation to the Purposes for which the Personal Data were collected or subsequently processed;

d) the "right to restriction of processing", i.e. the right to obtain from the Data Controller the restriction of processing in certain cases provided for under the Regulation;

e) the right to request the Data Controller to specify the recipients to whom he or she has notified any rectification or erasure or restriction of processing (made pursuant to Articles 16, 17 and 18 of the Regulation, in fulfillment of the notification obligation except where this proves impossible or involves a disproportionate effort);

f) the "right to data portability", i.e. the right to receive (or to transmit directly to another data controller) Personal Data in a structured, commonly used and machine-readable format;

g) the "right to object", i.e. the right to object, in whole or in part: 1)to the processing of Personal Data carried out by the Data Controller for its own legitimate interest; 2) the processing of Personal Data carried out by the Data Controller for marketing or profiling purposes. In the above cases, where necessary, the Data Controller will inform the recipients to whom the Data Subject's Personal Data are communicated of the possible exercise of the rights, except in specific cases in which this is not possible or is too burdensome and, in any case, in accordance with the provisions of the Privacy Legislation.

To protect your rights and to protect your data, any data subject may also, at any time, decide to lodge a complaint with the competent supervisory authority or to bring an action before the competent courts.
